IN THE MATTER OF THE COMMISSION ADOPTING POLICIES AS REQUIRED BY HOUSE BILL 07-1228.


House Bill 07-1228, was signed into law on June 1, 2007.  It charges the Commission with three main tasks as follows:

  • Develop a policy to establish incentives for consumers who produce Distributed Generation (DG);
  • Consider whether a credit program similar to the Renewable Energy Credit (REC) program of § 40-2-124, et seq. C.R.S., would work for consumers who produce DG; and
  • Present the Commission-developed policy and findings regarding the REC program to the House Committee on Transportation and Energy, and the Senate Agriculture, Natural Resources, and Energy Committee.

On June 18, 2007 the Colorado Public Utilities Commission opened Docket 07M-230E to develop a policy as required by House Bill 07-1228 to “establish incentives for consumers who produce distributed generation” and to “consider whether a credit program similar to the renewable energy standard..., would work for consumers who produce distributed generation.” In response, initial and reply comments were submitted by numerous interested persons.

Commission Staff organized a workshop for interested parties to discuss policy issues related to the implementation of House Bill 07-1228. The workshop was held August 21, 2007, Commission Hearing Room A.
