| Administrative Law Judge ("ALJ") |
Judge who presides over an administrative hearing and renders an Initial Decision to the Agency. |
| Agency |
As used in these definitions, the Agency may be a Board, or Panel of the Board, appointed by
the Governor to regulate the profession or occupation or the Agency may be the Director
who, by law, has decision-making authority with regard to disciplinary actions. |
| Agreement |
An Order of the Agency that is an agreement between the Agency and the licensee without a
formal hearing, which resolves the case. In an agreement, both parties agree to facts,
sanctions and the terms and conditions for continued practice, if applicable. |
| Cease and Desist Order ("C&D") |
Agency Order advising the recipient to cease activity that is in violation of Colorado law. |
| Complainant |
A person who files a complaint. |
| Final Agency Order ("FAO") or Final Board Order ("FBO") |
Final Order issued by the Agency after a formal hearing before an ALJ where evidence and
testimony were presented. The ALJ prepares a written report of the findings (ref. Initial
Decision below) which the Agency reviews and then makes the final ruling regarding the
appropriate sanction. |
| Fines |
Fines levied in accordance with the criteria set forth in the Agency's statute. |
| Formal Complaint or Notice of Charges |
The document filed with the ALJ by the Agency's attorney that sets forth the charges
being made against the licensee by the Agency and the provisions of the law the Agency
believes it can prove that the licensee violated. It is also important to note that
any Formal Complaint or Notice of Charges is an accusation, and does not constitute a
final action by the agency. \

| Initial Decision |
The written document issued by the ALJ following a hearing that is then transmitted
back to the Agency. |
| Injunction |
A court order that requires the recipient to cease activity that is in violation
of Colorado law. |
| Letter of Admonition ("LOA") |
A public reprimand issued to the licensee in the form of an actual letter
or as part of a stipulation. |
| Probation |
The period of time a licensee must comply with required terms and
conditions to be able to continue to practice. |
| Respondent |
The licensee who is the subject of the disciplinary action. |
| Revocation |
The license to practice is completely taken away. |
| Stipulation and Final Agency Order |
An Order of the Agency that is an agreement between the Agency and the licensee without a
formal hearing, which resolves the case. In a stipulation, both parties agree to facts,
sanctions and the terms and conditions for continued practice, if applicable. |
| Surrender or Relinquishment |
An Order of the Agency that is an agreement between the Agency and the licensee in which the
licensee agrees to give up his or her license to practice. Such surrender or
relinquishment may be permanent or the agreement may allow the licensee the ability to
apply for a new license in the future. |
| Suspension |
The licensee may not practice for a specified period of time. However, some suspensions may be
indefinite. If a suspension is for a finite period of time, the license will be returned
automatically at the end of that time period or when the conditions of reinstatement are
met. The Agency sometimes states conditions that must be met by the licensee before the
license will be reinstated such as requirements for re-education, psychiatric evaluation
and treatment, or completion of treatment for alcohol or drug abuse. |
| Summary Suspension |
An immediate temporary withdrawal of the licensee's ability to practice pending prompt
commencement of formal disciplinary proceedings. |
