How to file a complaint against a Colorado licensee.

If you have reason to believe that a Colorado licensee has acted improperly in a transaction you are involved in, contact the enforcement section of the Division of Real Estate.

Filing a Complaint With The Real Estate Commission

Errors and Omissions Insurance: Every active Colorado licensee is required by law to maintain a Policy or Errors and Omissions liability insurance. In the event the public suffers financial damages as a result of an unintentional act or omission by a licensee. This insurance may cover the loss. Consult your attorney regarding how to proceed.

Mediation: Real Estate Commission approved listing and contract forms contain an alternate dispute resolution clause specifying mediation as a method of resolving disputes that cannot be settled by the parties to the contract.

The American Arbitration Association defines mediation as a process by which parties submit their dispute to a third-party neutral (the mediator) who works with them to reach a settlement. Arbitration is less formal than litigation and mediation is even less formal than arbitration. The mediator does not have the power to render a binding decision, but this type of dispute resolution process has several advantages over other remedies.
