Beginning on July 1, 2011 a tax credit shall not be allowed unless the appraiser who prepared the appraisal has completed the Conservation Easement Appraiser Update Course. Failure to complete the course prior to July 1, 2011 will disqualify any appraisal completed after that date for use as substantiation of a state conservation easement tax credit claim.
Course Outline
The Division of Real Estate has designed a general course outline for the Conservation Easement Appraiser Update Course with the intent of allowing approved providers to teach the course. The outline covers required content while allowing flexibility for the providers to tailor and adapt the course utilizing current and relevant information.
Instructors / Providers: The Conservation Easement Appraiser Update Course must include each topic listed in the outline if there have been changes within two years of the date course approval is sought. If for example the Board of Real Estate Appraisers (Board) has not changed or enacted a new rule affecting the appraisal of conservation easements in the past 2 years, discussion of Board rules does not need to be covered.
Each course offering must be approved by the Board for at least 2 hours of continuing education. A detailed outline must be included with the application for continuing education approval. Instructors / providers are responsible for submitting the course for continuing education approval. If continuing education approval is not obtained the course shall not satisfy the requirement of Board Rule 16.4.

Course Background
Update Course participants are assumed to have an extensive knowledge of appraisal practice. The Course is designed for Certified General Appraisers with the knowledge and experience to appraise conservation easements.
Pursuant to section 12-61-719 (7), C.R.S. the Colorado Board of Real Estate Appraisers (BOREA) has the authority to establish classroom education and experience requirements for an appraiser who prepares a conservation easement appraisal. Such requirements shall be established to ensure that appraisers have a sufficient amount of training and expertise to accurately prepare appraisals that comply with the Uniform Standards of Professional Appraisal Practice and any other provision of law related to the appraisal of conservation easements.
A tax credit shall not be allowed unless the appraiser who prepared the appraisal met all requirements established in accordance with subsection (7) in effect at the time the appraisal was completed.
Conservation easement appraisers will be required to complete the Conservation Easement Appraiser Update Course once every two years. The course will count towards continuing education credits for licensed appraisers.
The Division will offer the course three times before it is required of conservation easement appraisers. The first course will be offered in November of 2010, the second in March of 2011 and the third in May of 2011. The Division will provide the course approximately twice a year after the initial three offerings. Details of course dates and locations will be made available once they are finalized.
