HOA Information Office and Resource Center

The HOA Information Office and Resource Center provides information on the rights and duties of homeowners and associations under the Colorado Common Interest Ownership Act. The Office is responsible for tracking inquiries and complaints.

Mission Statement

In 2010 the Colorado General Assembly passed House Bill 10-1278 creating the HOA Information Office and Resource Center . The HOA Information Office was created to compile statistical information related to homeowners’ associations; including the number of HOA’s in Colorado; basic information regarding the HOA; and information pertaining to issues homeowners and HOAs are having. The Office also serves as a resource for Colorado consumers providing information about living in an HOA and assisting homeowners, HOA boards, declarants and other interested parties in understanding their rights and responsibilities under the Colorado Common Interest Ownership Act (“CCIOA”). The HOA Information Office has recently released its 2011 Annual Report highlighting its findings from 2011.


Annual Registration

In addition to the annual Secretary of State Registration, HOAs are required to register with the Colorado Division of Registration once per year.   HOA’s can register online at https://www.dora.state.co.us/pls/hoa/HOA.logon. Associations who collect over $5,000 in assessments (both annually and through special assessments) are required to pay a fee of $43.00, plus additional processing costs.  An HOA who fails to register, timely renew, or pay the required fee may be precluded from imposing or enforcing a lien for assessments as noted in § 38-33.3-401(3), C.R.S.   Consumers can also search the HOA Information Database for registered HOAs at https://www.dora.state.co.us/pls/hoa/HOA_Search_UI.search/.  Note that not all HOAs are registered.  Questions relating to HOA registration; issues with the HOA registration database; or questions about locating specific HOAs or property management companies can be directed to Cynthia Aguilar at 303-894-2292 or cynthia.aguilar@dora.state.co.us.

Special Note Regarding Fee Change: The registration fee for 2012 is currently set at $43 dollars, which is higher than the previous fee because last year’s fee only recovered a portion of the program’s annual costs.  In future years we expect this fee amount to stabilize in step with required expenditures and overall HOA registration numbers. The maximum annual registration fee allowed by statute is $50. There is no late fee.


Complaints

The HOA Information Office strives to assist homeowners and other consumers in answering general HOA questions; assist homeowners in navigating issues with their HOAs; and compiling data on issues homeowners are having.  The HOA Information Office does not have regulatory or investigative authority and cannot intervene in disputes. 

The HOA Information Office CAN:

  • Provide resource information and HOA related laws to homeowners which relate to their specific situations;
  • Discuss with homeowners and consumers possible ways to address problems;
  • Provide referrals to other governmental entities and resources that may be able to address their issues;
  • Compile information on complaints for use in annual reporting and statistical data gathering;
  • Provide information regarding HOA related legislative initiatives.

The HOA Information Office CANNOT:

  • Provide legal advice, including interpreting governing documents or laws;
  • Intervene in disputes with HOA boards or managers;
  • Investigate or otherwise discipline HOA boards or managers for violations of law;
  • Attend board or committee meetings;
  • Provide information regarding whether a complaint has been filed against a specific HOA;
  • Provide assistance or information regarding foreclosure proceedings  
  • Assist with assessment billing issues between homeowners, boards and management companies
