Confidential Documents
When you file a document in the E-Filings system, you request that each document be treated with one of three increasingly more private levels of confidentiality (learn how E-Filings protects your confidential documents)...
  1. Non-confidential: A non-confidential document is viewable by any user of the E-Filings system, including parties to a case where the document is filed, as well as the general public. The majority of filed documents fall into this category.
  2. Confidential: Information claimed by a filer to be Confidential is filed under the terms of Rule 1100 of the Rules of Practice and Procedure. These documents are part of the official record of a case but are not generally available to the public. Rather, they can only be accessed by individuals that a party to the document has authorized. The authorized individual must have executed, filed and served a written certification that they have read Rules 1100 - 1102 of the Rules of Practice and Procedure and agree to be bound by the terms of those provisions. The E-Filings system will not allow anyone not employed by the Commission to access confidential documents and is never viewable by the general public or by any party to the case other than the filer. Parties may access confidential information from the party claiming confidentiality pursuant to Commission rules (e.g., after an individual has signed a non-disclosure or obtained a Commission order). Examples of documents normally claimed to be confidential contain trade secrets or other information that might risk a competitive disadvantage. Filers claiming this designation should pay particular attention to Rule 1100(c).
  3. Highly confidential: The E-Filings system will not allow anyone not employed by the Commission to access highly confidential documents and is never viewable by the general public or by any party to the case other than the filer. If a party believes that information requires extraordinary protection beyond that provided for by the Commission's rules, then the party shall submit a motion pursuant to Rule 1100 seeking and specifying such extraordinary protections. Access to information designated by Commission Order, or subject to a pending motion requesting designation, as highly confidential is accessible solely subject to the protective provisions ordered by the Commission and will never be available to the general public or any party other then the Commission and its staff, through the E-Filings system.
