Review of Proposals for Mandatory Continuing Education

The Office is the research arm of the Executive Director of the Department of Regulatory Agencies. Duties of the Office include:

Prepare sunrise reviews. A sunrise review examines whether or not there is a need to regulate a previously unregulated occupation or profession. Statutory criteria are used to evaluate all proposals for new regulatory programs.

With the passage of HB07-1311, DORA may decline reviews in certain circumstances, such as in the case of a repeat application with no new information provided or in cases where a profession or occupation is posing an imminent threat to the public's health, safety or welfare. Additionally, DORA is required to produce sunrise reviews in an expedited time frame - no later than 120 days after receipt of a sunrise application. To request an application, please e-mail the Office of Policy, Research and Regulatory Reform.

Conduct sunset reviews. State agencies are reviewed according to a statutory review schedule and according to statutory criteria. A sunset review discusses whether the agency under review should be continued without changes, continued with changes or terminated.

Conduct reviews of advisory committees. Advisory committees are also scheduled for review according to a statutory schedule. An advisory committee's composition, mission and accomplishments are reviewed to determine whether the committee has fulfilled its statutory mandate(s) and whether there is a need for its continued existence.

Conduct reviews of legislative proposals for mandatory continuing education. Pursuant to statute, any group or association proposing a mandatory continuing education requirement or a continuing competency requirement that includes mandatory continuing education, for any regulated occupation or profession, in any bill before the General Assembly, must first submit information concerning the need for such a requirement to the Department of Regulatory Agencies. The Office of Policy, Research and Regulatory Reform reviews and analyzes the evidence and the proposal and reports in writing to the General Assembly within 45 days whether continuing competency with mandatory continuing education or mandatory continuing education alone would likely protect the public served by the practitioners. To initiate this process, please e-mail the Office of Policy, Research and Regulatory Reform for the necessary requirements.

Conduct regulatory reform activities. With the passage of Senate Bill 03-121, state agencies send a copy of proposed rules to the Office of Policy, Research and Regulatory Reform so that the Director can evaluate the proposed rule to determine if a cost-benefit analysis should be performed by the agency.

With the passage of HB06-1041, state agencies are now required to also submit a "statement, in plain language, concerning the subject matter or purpose of the proposed rule or amendment" with their rule submission.

The Office analyzes and evaluates the impact of proposed rules and regulations on small businesses, job creation and economic competitiveness. The Office acquires feedback from consumers and businesses effected by proposed rules and regulations. Through Regulatory Notices, citizens and business owners are able to keep abreast of proposed rule changes and are provided with an opportunity for on-line input into the state rulemaking process.
