The Michael Skolnik Medical Transparency Act of 2010 mandates that specific healthcare professionals complete online healthcare profession profiles prior to the renewal, certificate or registration. This optional webinar will outline the new requirements and demonstrate the online system licensees will use to manage their compliance.

The Michael Skolnik Medical Transparency Act of 2010.

Senate Bill 10-124 enacts the "Michael Skolnik Medical Transparency Act of 2010" to extend reporting requirements to many health care professionals who apply for or renew a license, certification, or registration, on or after July 1, 2011.  Currently licensed Dentists, Retired Dentists, Dental Hygienists, and Academic Dentists will be required to complete online profiles at their next renewal in 2012.  All newly licensed Dentists, Retired Dentists, Dental Hygienists, and Academic Dentists after July 1, 2011 will be required to complete online profiles before their applications will be approved.

Colorado Enacts New Dental and Dental Hygiene Laws

On March 18, 2009, Governor Bill Ritter, Jr. signed House Bill 09-1128 into law effective August 4, 2009. This is a bill concerning the establishment of an academic license to allow a dentist employed by a school of dentistry to engage in the practice of dentistry in connection with programs affiliated with the school. A dentist who is employed at an accredited school or college of dentistry in this state and who practices dentistry in the course of his or her employment responsibilities shall obtain either an Academic Dentist license or a regular Colorado Dental license. A dentist practicing with an academic dentist license may not use the license to practice dentistry outside his or her academic responsibilities.  At this time, this new law only affects dental faculty at the University of Colorado Denver School of Dental Medicine. On April 22, 2009, Governor Bill Ritter, Jr. signed Senate Bill 09-129 into law and the bill became effective immediately. This bill revises the duties that may be performed by a dental hygienist, both supervised and unsupervised. Also, a new definition has been included defining a dental hygiene diagnosis. A portion of this bill requires a practicing dental hygienist to maintain either his or her own professional liability insurance or through a supervising dentist in the amount of not less than $50,000 per claim and an aggregate liability limit for all claims during a calendar year of not less than $300,000. Colorado Enacts New Laws Regarding Dental Practice Ownership Requirements

On March 20, 2008, Governor Bill Ritter, Jr. signed House Bill 08-1134 into law effective August 5, 2008. A portion of this bill concerns the disclosure of the ownership of a practice that provides dental care to patients. This law will directly affect all dental or dental hygiene practices in Colorado. Specifically, this new law requires that certain information regarding the ownership of the dental or hygiene practice be available upon request at the reception desk of the practice during normal business hours. The law further provides that this information be made available on a form approved by the Board. This ownership form is available on the Board’s website here. The availability of this information is a mandatory requirement, effective August 5, 2008.

Another important provision in this legislation is that it allows an heir to the dentist or dental hygienist to serve as a proprietor of the deceased’s practice for up to one year after their death, regardless of whether the heir is licensed to practice. And that upon good cause shown, may petition the Board for an extension of the temporary ownership period by up to an additional twelve months, if necessary, to allow them sufficient time to sell or otherwise dispose of the practice.


Electronic Prescription Drug Monitoring Program

PRESCRIPTION DRUG MONITORING PROGRAM (“PDMP”)
The PDMP is available for online queries from the following Colorado licensed individuals:

  • Physicians;
  • Dentists;
  • Physician Assistants;
  • Veterinarians;
  • Nurses with Prescriptive Authority;
  • Podiatrists;
  • Optometrists;
  • Pharmacists; and
  • Resident Physicians with Training Licenses.


The PDMP was originally authorized by law in 2005 and reauthorized in 2011. The PDMP provides a secure database of controlled substance prescriptions that have been dispensed by registered Colorado pharmacies. The purpose of the database is to provide objective information to assist practitioners and pharmacists in providing appropriate treatment for their patients. The program allows practitioners and pharmacists to gather information about the patients they serve and to ensure that their prescribing and dispensing is appropriate for the circumstances presented.

The information in the PDMP is considered a medical record, and falls into the statutory provisions concerning policies, procedures, and references to the release, sharing, and use of medical records and health information. Please remember that you may not share your user password, office staff may not utilize the PDMP on your behalf, and you may only access information on patients you are caring for.  The law provides that individuals that inappropriately access, utilize, or release information from the PDMP may be fined.

Each prescriber must disclose to patients for whom he/she is prescribing a controlled substance that the patient’s prescription information will be loaded into the PDMP and may be queried by authorized individuals. Each pharmacy must disclose to patients who are receiving controlled substances that their prescription information will be loaded into the PDMP and may be queried by authorized individuals.
