Major Rule Changes on January 1, 2012 Affecting…

Licensed Architects:

  • Effective January 1, 2012, the CE (continuing education) requirements for license renewal change to align with a new national model. The purpose is to ease the burden on those licensed in multiple jurisdictions and increase the standardization of continuing education requirements. Major changes in Colorado include the following items.
    • .Professional Development Units (PDUs) are now Continuing Education Hours (CEHs). Please refer to Board Rule 4.9.3.1.2.4.
    • . The credit required is a minimum of 12 CEHs per calendar year for a total of 24 CEHs during the renewal year. Please refer to Board Rule 4.9.3.1.2.5.
    • No carryover credit will be allowed from prior renewal periods. Any CEHs gained prior to 2012 cannot be used toward the renewal of the October 31, 2013 license and CE requirements. Please refer to Board Rule 4.9.3.1.2.7.
    • The Health Safety, and Welfare subjects witin which you may take CEHs are defined more specifically. Please refer to Board Rule 4.9.3.1.8.
    • Documentation must be retained for six years instead of five. Please refer to Board Rule 4.9.3.1.2.14.
    • An exemption for required CE has been added for those who are called to federally funded active military duty for more than 120 days within a renewal cycle. Please refer to Board Rule 4.9.3.1.2.15.

  • Effective January 1, 2012, Architects may sign and seal documents that are not final, but the documents must be identified as preliminary. Please refer to Board Rule 7.3.5.

Engineering Applicants:

  • Effective January 1, 2012, applicants who have been denied permission to take an examination for lack of experience credit have a specific timeframe within which to gain the credit and request reconsideration before the application is purged. Please refer to Board Rule 4.3.5.

Licensed Professional Engineers :

  • A new rule regarding grading and drainage certificates and the responsibilities of Professional Engineers has been promulgated into Board Rule 5.2.3.

Surveyor Applicants:

  • Effective January 1, 2012, applicants who have been denied permission to take an examination for lack of experience credit have a specific timeframe within which to gain the credit and request reconsideration before the application is purged. Please refer to Board Rule 4.3.5.
  • The requirements for a Board-approved 2-year surveying degree and a Board-approved 4-year engineering degree have been certified. Please refer to Board Rules 4.7.2.2 and 4.7.2.3.

Licensed Professional Land Surveyors:

  • A new rule regarding grading and drainage certificates and the responsibilities of Professional Engineers has been promulgated into Board Rule 6.2.3.

Major Rule Changes on June 1, 2011 Affecting…

All Applicants:

  • Effective June 1, 2011, new rules go into place that concern the compliance with examination policies and procedures for engineering, land surveying and architecture examinees. Please refer to Board Rule 4.8.3, 4.8.3.1, 4.8.3.2 and 4.8.3.3.

Engineering Applicants:

  • Effective June 1, 2011, a new rule recognizes changes concerning the new Principles and Practice of Engineering Examination in structural engineering.  Please refer to Board Rule 4.8.2.2.1.

Major Rule Changes in October and November 2010 Affecting…

All Licensees:

  • A new rule effective January 1, 2011 requires that licensees are required to inform the Board of any address, phone, or email changes within 30 days.  Refer to Rule 4.11.

Architect Licensure Applicants:

  • Effective January 1, 2011, Board Rule 4.4.1 requires that experience be obtained following the NCARB Intern Development Program (IDP) criteria, with two exceptions: hours may be earned when working a minimum of 20 hours per week for a minimum of 6 consecutive months; and, hours may be earned in Training Setting F only when working as a full-time employee.  More information can be found in the Board Rules.
  • Effective January 1, 2014, all applicants for licensure will be required to demonstrate the required experience by completing the NCARB IDP program.  Please refer to Board Rule 4.4.1.1.
  • ARE Early Eligibility - Effective January 1, 2011, applicants with a NAAB degree who are enrolled in IDP may take any division of the ARE.  Refer to Board Rule 4.8.2.

Licensed Architects:

  • Pursuant to HB10-1148 that eliminates the requirement of continued competency for Architects to renew their license, all references to continued competency have been deleted from the Board Rules.  Note however, that Architects are still required to complete 16 hours of continuing education in order to renew their license.  The continuing education must include a process or procedure that demonstrates whether the Architect retained the material presented in the CE activity.  Please refer to Board Rule 4.9.3.1.2 for details.
  • Effective January 1, 2011, a new Board Rule 7.3 Construction Observation as the Practice of Architecture will go into effect.  It parallels a Board Rule 5.3 for Professional Engineers.

Engineering Applicants:

  • Effective January 1, 2011, no credit for employment experience will be given for summer jobs, part-time jobs, or full-time jobs when attending undergraduate school.  Please refer to Board Rule 4.6.4.
  • No employment experience that is less than 6 months continuous duration with one employer will be credited.  Please refer to Board Rule 4.6.5.

Licensed Professional Engineers:

  • Previous Board Policy 50.1 regarding Materials Testing has been promulgated into Board Rule 5.4.

Surveyor Applicants:

  • Requirements for a Board-approved 2-year surveying degree, a Board-approved 4-year engineering degree, and a Board-approved 4-year non-surveying or a non-engineering degree have been revised or created at the behest of House Bill 10-1085 and can be found in Board Rule 4.7.2. 
  • Changes have been made as to what credit is allowed for those without a surveying degree.  The major change is that trigonometry is now allowed.  Please refer to Board Rule 4.7.2.5.
  • Effective January 1, 2011, no credit for employment experience will be given for summer jobs, part-time jobs, or full-time jobs when attending undergraduate school.  Please refer to Board Rule 4.6.4.
  • No employment experience that is less than 6 months continuous duration with one employer will be credited.  Please refer to Board Rule 4.6.5.

Licensed Professional Land Surveyors:

  • Board Rules 6.4.3 and 6.5.3.2 have been revised to refer to the “United State Department of the Interior, 2009 Manual of Surveying Instructions: For the Survey of the Public Lands of the United States.”
  • Previous Board Policy 60.1 Basis of Bearing Statements has been promulgated into Board Rule 6.8.
  • Previous Board Policy 60.2 Depiction of Easements and Rights of Way on Subdivision Plats has been promulgated into Board Rule 6.10.
  • Previous Board Policy 60.3 Require Monumentation for Land Survey Plats has been promulgated into Board Rule 6.11.
  • Previous Board Policy 60.4 Monumentation of ALTA/ACSM Land Title Surveys has been promulgated into Board Rule 6.12.
  • Previous Board Policy 60.5 Description of Monuments has been promulgated into Board Rule 6.13.

Engineer and Surveyor Examinees:

  • Elimination of Policy 40.5 (a new rule is being developed).

Licensed Professional Engineers:

  • Board Policy 50.1 regarding Materials Testing has been repealed and promulgated into Board Rule 5.4.
  • Board Policy 50.2 regarding Engineering in Natural Hazard Areas has been repealed.

Licensed Professional Land Surveyors:

  • Previous Board Policy 60.1 Basis of Bearing Statements has been repealed and promulgated into Board Rule 6.8.
  • Previous Board Policy 60.2 Depiction of Easements and Rights of Way on Subdivision Plats has been repealed and promulgated into Board Rule 6.10.
  • Previous Board Policy 60.3 Require Monumentation for Land Survey Plats has been repealed and promulgated into Board Rule 6.11.
  • Previous Board Policy 60.4 Monumentation of ALTA/ACSM Land Title Surveys has been repealed and promulgated into Board Rule 6.12.
  • Previous Board Policy 60.5 Description of Monuments has been repealed and promulgated into Board Rule 6.13.

Board Proceedings:

  • Board Policy 70.4.3 – Execution of Board Procedural Orders and 70.4.4 – Review of Initial Decisions Upon Default document the delegation of authority to the Board’s Program Director in certain ways with regard to the handling of Initial Decisions.
  • Board Policy 70.5 Issuance of Certain Discipline in Open Session has been created to document the Board’s approach to handling certain types of discipline in open board meetings.

Legislative History:

  • House Bill 10-1085: The legislation requires that the Board specify appropriate surveying course work through the rulemaking process that would meet the statutory requirements for a 2-year surveying curriculum, a 4-year engineering curriculum, or a 4-year non-surveying curriculum in order to qualify to take the Principles and Practice of Surveying licensing examination.  This must be done and in effect by January 1, 2011.

    The bill also eliminates the ability to become licensed as a Professional Land Surveyor without education beyond graduation from high school on July 1, 2020.

    The bill also specifies procedures for issuance of a surveyor’s affidavit of correction.

  • House Bill 10-1148: This bill eliminates continuing competency but it leaves in place the requirement for mandatory continuing education in order to renew a license to practice architect
  • Senate Bill 08-029: This act requires architects to complete continuing education every two years in order to renew their Colorado architect’s license.  It also requires the State to development a process for architects to demonstrate continued competency.
  • House Bill 07-1225: This Professional Land Surveying law covers several areas, one of which now allows seniors in an accredited surveying program to take the FS exam. Please see the attached Act for specifics on all areas. The Act is effective at 12:01 am on August 8, 2007.

  • House Bill 06-1183: 2006 legislation that changes what is required on land survey plats

  • House Bill 06-1196: 2006 legislation combining the Board of Examiners of Architects with the Board of Licensure for Professional Engineers and Professional Land Surveyors.
