The Real Estate Commission is charged by statute with licensing real estate brokers. Once licensed, the Commission has a continuing obligation to protect the public from dishonest or incompetent licensees. To that end the Enforcement Section investigates complaints filed by the public against licensees. The section is composed of a supervisor, 7 investigators and 2 administrative assistants.
The Commission has the power to admonish, censure, suspend or permanently revoke a license upon a finding of a violation of license law or Commission rule. The Commission may levy fines against licensees in addition to any other action taken. Educational courses may also be imposed as part of any disciplinary action. Except in the case of a stipulated agreement with the licensee, a hearing before an Administrative Law Judge must be held before disciplinary action can be imposed.
The Commission, by statute, is limited to disciplinary action. Therefore, it cannot award money damages, arbitrate disputes or prosecute alleged crimes. Matters such as these are handled through appropriate civil or criminal proceedings.
